SEPA Enforcement Policy and Guidance

Scottish Land & Estates has this week responded to the latest SEPA consultation aimed at implementing aspects of the Better Regulation agenda.  SEPA were consulting on their new Policy and Guidance documents setting out how they will undertake enforcement action.  The new policy highlights that SEPA can follow a number of routes when deciding on the best course of enforcement action and much depends on the individual circumstances of a case.  This approach is intended to result in a lighter touch being taken with unintentional  minor breaches freeing up resource to deal more effectively with major and/or persistent offenders.  Scottish Land & Estates is supportive of this ethos and therefore of the policy intention and guidance.  We will of course continue to review how the new approach is implemented in practice.
