Following on from the recent publication of a short-from arbitration process to deal with disputes over farm rents, the Tenant Farming Forum (TFF) have now published two sets of guidance, one on diversification and another on the resolution of disputes.
These documents are intended to clearly set out the issues as they exist under current legislation, so as to clarify things for both tenants and landlords and to highlight good practice.
The guidance on diversification is concerned with business diversifications which are outside the scope of agriculture but are farm-based. It covers the principles of diversification on tenanted land; preparing for diversification; landlord’s consent; landlord’s reponses and notices; good practice in diversification; and resolution of disputes.
The guidance on the resolution of disputes sets out a stage by stage approach to dispute resolution and advocates resolution, wherever possible, at the lowest point of the ladder of escalation.
