Agricultural Holdings Bill Stage 1 Debate

The Scottish Parliament held its Stage 1 Debate this week.  This bill includes provisions to extend the definition of "near relative" to include grandchildren, prohibit upward only rent reviews and clarify the issue relating to VAT rate changes and rent reviews, thus completing the full package of TFF agreed proposals.  Scottish Land & Estates issued a briefing on the Bill. This included an acceptance of the proposal to introduce transitional measures with a retrospective element.

All speakers supported the Bill. The Cabinet Secretary for Rural Affairs intimated that he will only be bringing one amendment, on the transitional provisions, at Stage 2. He was also very clear that he did not wish to see rushed changes to legislation that are not given sufficient scrutiny.  He said that he would not be bringing forward any amendments on Section 13 of the 1991 Act following the Moonzie decision, but he would be meeting with the TFF at the beginning of April to discuss the way forward.
